1. Legal Framework

1.1. Contractual Relationship

These Terms and Conditions (“Terms”) govern your access to and use of the mobile applications, vehicles, websites, content, products, and any related services (collectively, the “Services”) provided by Silver Sign for Business SPC, operating under the brand name Sofred Mobility, a company registered in the Sultanate of Oman under Commercial Registration No. 1419381, with its headquarters located in Al-Aqur, Nizwa, Oman, P.O. Box 1561 (“SOFRED”, “we”, “us”, or “our”).

These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oman.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES.

By accessing or using any part of the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, thereby entering into a legally binding contractual relationship with SOFRED. If you do not agree to these Terms, you must not access or use the Services.

These Terms supersede and replace any prior agreements or understandings between you and SOFRED regarding the use of the Services.

SOFRED reserves the right to suspend, restrict, or terminate your access to the Services at any time and for any reason, including for violations of these Terms.

1.2. Supplemental Terms

Certain Services may be subject to additional or supplemental terms and conditions, such as those relating to specific operating location,  promotions, events, or specific features. These supplemental terms form an integral part of this agreement and shall apply in addition to these Terms. In the event of a conflict between these Terms and any applicable supplemental terms, the supplemental terms shall prevail with respect to the applicable Service.

1.3. Amendments

SOFRED reserves the right to modify or update these Terms at any time. Any changes will become effective upon posting the revised Terms on this page or within the Services. Your continued use of the Services after such updates constitutes your acceptance of the amended Terms. We encourage you to review the Terms periodically to stay informed of any changes.

2. Privacy and Data Handling

2.1. Privacy Policy Acknowledgement

Users acknowledge and agree to the terms outlined in SOFRED’s official Privacy Policy, available at our app privacy page or (https://sofredmobility.com/privacy-policy-english). This includes how data is collected, stored, and used.

2.2. Data Sharing with Third Parties

In cases of complaints, disputes, accidents, or legal requirements, SOFRED may share necessary personal data (e.g., name, contact details, trip info) with authorities, insurers, or legal representatives to comply with regulations and investigate incidents.

2.3. Data Retention and Access

SOFRED retains personal and ride-related data for a duration aligned with business needs and legal obligations. Users may request access or deletion of their data, subject to local data protection laws and operational requirements.

3. Use of Services and License

3.1. Description of Services

The Services provided by SOFRED consist of a mobile-based platform that enables registered users to locate, unlock, and access electric vehicles—including scooters and bicycles—for short-distance, personal transportation. Through the SOFRED application and integrated systems, users may view nearby vehicles, initiate rides, monitor trip details, and manage their accounts.

These Services are intended for individual use only and are made available in specific operational zones as determined by SOFRED.

3.2. Service Limitations and Clarifications

SOFRED does not provide transportation or logistics services and is not a transportation carrier or a common carrier. Rather, SOFRED operates as a technology platform that facilitates self-service access to its fleet of vehicles.

Users acknowledge and accept the following limitations:

  • Availability of vehicles may vary by time, location, and demand.

  • SOFRED makes no guarantees regarding uninterrupted access to the Services.

  • The Services are intended for short-term, personal transportation only and may not be used for commercial, delivery, or passenger transport purposes unless explicitly authorized by SOFRED in writing.

  • Use of vehicles outside the designated operational zones is strictly prohibited and may result in suspension or fines.

3.3. License Grant and Usage Rights

Subject to full compliance with these Terms, SOFRED grants you a limited, non-exclusive, non-transferable, and revocable license to:

  • Download and use the SOFRED mobile application on your personal device;

  • Access and use the Services and their content solely for lawful and personal use.

You may not:

  • Remove any copyright, trademark, or proprietary notices from the Services;

  • Sublicense, sell, or commercialize any part of the Services;

  • Modify, reverse-engineer, copy, or attempt to extract source code from any software, hardware, or system belonging to SOFRED;

  • Use the Services for illegal purposes or in violation of these Terms.

  • Interfere with, disrupt, or compromise the integrity or security of the Services;

All rights not explicitly granted in this section are reserved by SOFRED and its licensors.

3.4. Third-Party Services and Integrations

The Services may include links to or integrations with third-party platforms, content, payment processors, or mapping services. These third-party services are governed by their own terms and conditions.

SOFRED does not endorse or assume responsibility for any third-party services, and your interaction with them is at your own risk. Any issues, claims, or disputes arising from the use of third-party services should be directed to those providers directly.




4. User Accounts

4.1. Account Registration Requirements

To access and use most features of the SOFRED Services, you must first register and maintain a personal user account (“Account”). By creating an Account, you confirm and agree that:

  • You are at least 18 years of age;

  • You are legally capable of entering into binding contracts;

  • You will provide accurate, current, and complete personal and payment information during registration;

  • You will maintain only one active Account unless expressly authorized by SOFRED in writing;

  • You will promptly update your account details, including payment methods, to keep all information accurate and valid.

SOFRED reserves the right to suspend or terminate your access to the Services if you provide false or outdated information, or violate any terms related to account registration.

4.2. Account Security and Responsibility

You are solely responsible for maintaining the confidentiality of your Account credentials, including your username and password. By using the Services, you agree to:

  • Not share your Account or login information with any other person;

  • Immediately notify SOFRED if you suspect unauthorized access or use of your Account;

  • Accept responsibility for all activities that occur under your Account, whether or not authorized by you.

  • Cooperate with identity verification procedures when required by SOFRED.

Unauthorized access to the Services using your credentials may result in temporary suspension, permanent deactivation, or legal action, at SOFRED’s discretion.

4.3. Text Messaging and Notifications

By registering for a SOFRED Account, you consent to receive communications from us, including but not limited to:

  • Verification codes for account security;

  • Ride-related updates and operational alerts;

  • Promotional messages and service announcements.

You may opt out of non-essential messages at any time by contacting support at Admin@sofredmobility.com. However, certain notifications (such as otp codes, transaction receipts, security alerts, and ride updates) are essential to the functionality of the Services and cannot be disabled without limiting your access.

5. User Conduct and Vehicle Usage

5.1 Acknowledgement of Safe Operation

By using a SOFRED vehicle, you confirm that:

  • You are familiar with the safe operation of the vehicle type provided (e.g., e-scooter).

  • You are physically and mentally fit to ride.

  • You will assess weather, road conditions, visibility, and traffic before and during the ride.

  • You will thoroughly inspect the vehicle before starting your ride, including checking the battery, brakes, lights, tires, accelerator, bells, and general frame condition.

  • If any issues, defects, or damages are noticed before starting the ride, you agree not to use the vehicle and to report the problem immediately through the SOFRED app.

  • You will adjust your riding behavior to match safety requirements, including proper braking, turning, and speed control.

SOFRED strongly recommends wearing a helmet and other safety equipment even if not legally required. You are responsible for your own safety and for complying with local traffic laws and regulations.

5.2 Prohibited Conduct While Operating a Vehicle

While using a SOFRED vehicle, you agree that you will not:

  • Carry items or bags that interfere with safe control of the vehicle.

  • Attach or suspend objects to or from the handlebars.

  • Use mobile phones, headphones, or other distractions while riding.

  • Operate the vehicle under the influence of alcohol, drugs, or medications that impair your ability to ride safely.

  • Carry passengers, including children or infants.

  • Use non-SOFRED locking mechanisms to secure or restrict access to the vehicle.

  • Use the vehicle for racing, stunts, off-road riding, or commercial purposes unless authorized in writing.

  • Exceed the vehicle’s maximum weight limit (200 kg). You are liable for any resulting damage or injury from overloading.




5.3 Helmet and Safety Equipment Recommendations

SOFRED encourages all users to wear a properly fitted helmet that meets safety standards. You are solely responsible for choosing whether to use a helmet or additional safety equipment.

Failure to wear a helmet may increase your risk of injury, and SOFRED shall not be held liable for injuries resulting from non-use of protective gear.

5.4 Vehicle Return and Incident Reporting

You are required to return the vehicle in the same condition in which you received it. In the event of an accident, injury, theft, or damage involving a SOFRED vehicle, you must:

  • Report the incident immediately through the SOFRED app or via email.

  • File a police report within 24 hours if injury or third-party damage occurs.

  • Cooperate fully with SOFRED’s investigation and provide any required documentation.

Failure to report incidents may result in account suspension, fines, or legal liability.

5.5 User Liability and Legal Responsibility

To the fullest extent permitted by law, you agree to be responsible for:

  • Any misuse of the Services or violation of these Terms;

  • All resulting damage, injury, penalties, or claims caused by your actions or negligence;

  • Costs related to vehicle repair, replacement, or recovery if caused by unauthorized use or breach of contract.

SOFRED reserves the right to deduct such costs directly from your Wallet or seek legal compensation.

5.7 Full User Guide and Responsibilities


This section summarizes core responsibilities of users when operating SOFRED vehicles. For a complete overview, including detailed definitions of misuse, prohibited actions, responsibilities, and safety procedures, users must refer to the official SOFRED User Guide, which forms an integral part of these Terms.


The User Guide includes:

- Eligibility criteria and onboarding steps;

- Instructions for safe and lawful vehicle use;

- A complete list of prohibited (misuse) actions;

- Emergency procedures and incident response;

- Defined responsibilities of the user, operator, and other parties.

Users are deemed to have read, understood, and accepted all content in the User Guide by agreeing to these Terms and by using SOFRED’s services.


5.7 Platform Security and Intellectual Property Protections

You agree not to:

  • Tamper with or reverse-engineer any part of SOFRED’s hardware or software;

  • Interfere with system security, disrupt network performance, or attempt unauthorized access;

  • Violate SOFRED’s intellectual property rights, including logos, designs, content, and trademarks.

Unauthorized use of SOFRED systems or materials is strictly prohibited and may lead to civil or criminal action.


6. Operational Rules

6.1 Vehicle Availability

You acknowledge that SOFRED vehicles are limited in number and availability may vary depending on time, location, demand, and maintenance schedules.

SOFRED does not guarantee the availability of a vehicle at any specific time or place. You agree that:

  • Access to vehicles is on a first-come, first-served basis.

  • Temporary shortages or unavailability shall not constitute a breach of service.

  • SOFRED is not liable for any inconvenience, delay, or loss caused by the unavailability of vehicles.

6.2 Operational Zones and Area Restrictions

Vehicles may only be used within designated operational zones, which are clearly marked in the SOFRED mobile application. You agree to:

  • Ride and park only within the approved zones.

  • Refrain from using vehicles on public highways, intercity roads, or other restricted areas.

  • Not end your ride outside of authorized SOFRED parking areas or charging stations.

Vehicles may automatically disable or lock if they are taken outside the permitted area. If a vehicle is impounded or confiscated due to use outside the allowed zones, you are solely responsible for all associated fines, recovery costs, or replacements.

6.3 Charging, Battery Limits, and Usage Warnings

SOFRED vehicles are battery-powered, and their performance depends on remaining battery levels.

You understand and agree that:

  • The battery level displayed before your ride is approximate and not guaranteed.

  • Battery levels may drop faster depending on usage, terrain, and weather.

  • It is your responsibility to ensure that sufficient battery power is available for your intended trip.

If the battery depletes during your ride:

  • You must safely stop and end your ride in accordance with these Terms.

  • You may not attempt to charge the vehicle yourself using unauthorized means.

  • SOFRED is not responsible for any disruption, injury, or inconvenience caused by mid-ride battery depletion.

6.4 Service Suspension in Emergencies or Bad Weather

SOFRED may temporarily suspend or restrict Services at any time due to:

  • Severe weather conditions (e.g., storms, rain, strong winds, extreme heat);

  • Government orders, public events, or emergencies;

  • Technical malfunctions, safety concerns, or maintenance.

During such suspensions:

  • Vehicle availability may be limited or disabled.

  • Users are advised not to ride in unsafe conditions, even if the system allows access.

  • SOFRED shall not be liable for service unavailability or losses due to such events.

You are responsible for using good judgment and riding only when it is safe to do so.

7. Payment, Wallet, and Promotions

7.1 Wallet System and Payment Methods

  • All Services are prepaid and require sufficient balance in your SOFRED Wallet.

  • Charges for rides, fines, and other applicable fees are automatically deducted from your Wallet.

  • You must ensure your Wallet is topped up to avoid service interruptions.

  • If your default payment method fails, SOFRED may attempt to charge any other linked method.

7.2 Refund Policy and Credit Expiry

  • Wallet top-ups are non-refundable once partially or fully used.

  • Promotional credits and bonuses are not redeemable for cash.

  • Refunds for unused top-ups must be requested within 3 days of the top-up date.

  • Refunds may take up to 4 working days to process.

  • Wallet credits expire 6 months from the date of top-up.

  • Inactive accounts may have remaining credit forfeited after 6 months, unless required otherwise by law.

  • SOFRED is not obligated to notify users before credits expire.

7.3 Charges and Pricing Structure

  • SOFRED reserves the right to change prices at any time.

  • Prices may vary depending on the city, zone, or time of day.

  • Check the Pricing section within the app before starting a ride to avoid misunderstandings.

  • SOFRED may increase rates during high-demand periods.

7.4 Deductions, Fines, and Penalties

SOFRED may deduct amounts from your Wallet for:

  • Fines due to improper parking or riding outside operational zones.

  • Damage to vehicles caused by misuse or negligence.

  • Unauthorized commercial use or account sharing.

  • Other violations of these Terms.

Promotional credits cannot be used to pay for fines or penalties unless explicitly stated.

7.5 Promotional Codes and Bonuses

SOFRED may offer promotional codes ("Promo Codes") that provide discounts, ride credits, or special offers.

By using a Promo Code, you agree that:

  • Codes are valid only for eligible users and lawful use.

  • Codes may not be transferred, sold, or published without written approval.

  • Misuse may result in account suspension or reversal of credited benefits.

  • Promo Codes may be deactivated, expired, or limited without notice.

  • Promo credits do not hold cash value and cannot be withdrawn.

8. User Content and Network Use

8.1 Submission of User-Generated Content

You may be permitted to submit content through SOFRED platforms, including but not limited to: feedback, reviews, photos, videos, or other media (“User Content”).

By submitting User Content, you agree that:

  • You retain ownership of your content but grant SOFRED a perpetual, royalty-free, transferable, and worldwide license to use, modify, display, distribute, and reproduce your content across any media.

  • You have the legal right and necessary permissions to share the content.

  • The content does not violate any laws, infringe on third-party rights, or contain offensive, defamatory, or inappropriate material.

SOFRED reserves the right to moderate, remove, or restrict any User Content at its sole discretion, with or without notice.

8.2 Network Access and Device Compatibility

To access and use the Services, you must:

  • Have a mobile device that meets minimum technical requirements.

  • Maintain an active mobile data connection through your carrier or internet provider.

  • Cover all associated charges from your telecom provider, including SMS fees and mobile data usage.

You understand and agree that:

  • The quality and reliability of the Services may be affected by your network provider, geographic location, and device performance.

  • SOFRED does not guarantee that the Services will work on all devices or under all conditions.

  • SOFRED is not responsible for service disruptions, delays, or limitations caused by external network issues, device incompatibility, or third-party outages.

9. Disclaimers and Limitations

9.1 Service Provided “As Is” Disclaimer

The Services are provided by SOFRED “as is” and “as available”, without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, SOFRED disclaims all warranties, including:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;

  • Any warranties that the Services will be error-free, uninterrupted, or secure;

  • Any guarantees regarding availability, reliability, or accuracy of ride data, location information, or service results.

You use the Services at your own risk. SOFRED does not guarantee that the vehicles or platform will meet your expectations or be free of delays, defects, or disruptions.

9.2 Insurance and Liability Limitations

Unless explicitly stated in these Terms or under a specific operation agreement, SOFRED DOES NOT provide any insurance coverage for:

  • Personal injuries;

  • Third-party injuries;

  • Property damage;

  • Theft, loss, or damage to user belongings.

You are solely responsible for maintaining any personal insurance that may be appropriate based on your usage of SOFRED vehicles.

Neither SOFRED nor its affiliates, employees, partners, or licensors shall be held liable for:

  • Accidents or injuries occurring during use of the Services;

  • Damage to personal property;

  • Medical expenses or other losses arising from your use or misuse of the Services.

If a specific operating area is covered by an active insurance policy provided by SOFRED, this will be explicitly stated within this section and Terms under a separate annex or addendum, or clearly outlined in the app under the operational details of that region.

Unless such coverage is clearly and specifically stated, you should assume that no insurance is provided by SOFRED for that area.

9.3 Force Majeure

SOFRED shall not be liable for any delay, failure in performance, or loss caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters, floods, storms, or earthquakes;

  • Government actions, regulatory restrictions, or public health emergencies;

  • Wars, riots, labor disputes, strikes, or civil disturbances;

  • Failures of telecommunications or power systems;

  • Acts of third parties or hackers.

In such cases, SOFRED may suspend or modify Services without prior notice and shall not be obligated to compensate users for temporary unavailability.

9.4 Limitation of Liability

To the maximum extent permitted by law, SOFRED shall not be liable for any:

  • Indirect, incidental, special, exemplary, punitive, or consequential damages;

  • Loss of profits, business interruption, data loss, or property damage;

  • Costs related to vehicle towing, impoundment, or recovery;

  • Issues resulting from third-party services or integrations.

In any case, SOFRED’s total liability for any claim shall not exceed the total amount paid by you to SOFRED in the 3 months preceding the incident giving rise to the claim.



9.5 Indemnification Clause

You agree to indemnify, defend, and hold harmless SOFRED and its officers, directors, employees, affiliates, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Services;

  • Your breach of these Terms;

  • Your violation of any applicable law or rights of a third party;

  • Any User Content you submit that infringes third-party rights or violates legal standards.

This indemnity survives the termination of your use of the Services and/or your Account.


10. Governing Law and Dispute Resolution

10.1 Applicable Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws and regulations of the Sultanate of Oman.
Any dispute, claim, or controversy arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Oman.

10.2 Optional Mediation/Arbitration Before Legal Action

Before initiating formal legal proceedings, you and SOFRED agree to first attempt to resolve the dispute through informal negotiation or mediation, to be conducted in good faith within 30 days of written notice of the dispute.

If informal resolution is unsuccessful, either party may elect to submit the matter to arbitration before pursuing litigation, subject to mutual consent and Omani arbitration laws.

This section does not waive SOFRED’s right to seek interim injunctive relief or immediate legal remedies for violations of intellectual property rights or misuse of the Services.



11. General Provisions

11.1 Assignment and Transfer of Terms

You may not assign or transfer your rights or obligations under these Terms without SOFRED’s prior written consent.

SOFRED may freely assign or transfer these Terms to:

  • A subsidiary or affiliated company;

  • An acquirer of its business or assets;

  • A successor entity in the event of a merger or restructuring.

11.2 No Agency or Employment Relationship

Nothing in these Terms shall be interpreted as creating a joint venture, partnership, employment, or agency relationship between you and SOFRED.
You agree that you are using the Services as an independent individual and not as an agent or representative of SOFRED.

11.3 Severability of Terms

If any provision of these Terms is found to be illegal, invalid, or unenforceable by a competent authority, such provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
The invalid provision shall be replaced with a valid one that best reflects the original intention.

11.4 Entire Agreement Clause

These Terms, along with any applicable supplemental terms, constitute the entire agreement between you and SOFRED with respect to your use of the Services.
They supersede all prior agreements, communications, or understandings—oral or written—between the parties regarding the subject matter.
